1. Who Can Use MyEchoes

You must be at least 13 years old to use MyEchoes.

By using the Service, you represent that:

• You are at least 13 years of age
• If you are under 18, you have your parent or guardian's permission
• You have the legal capacity to enter into these Terms
• You are not prohibited from using the Service under applicable law

We may refuse service, close accounts, or remove content at our discretion.

2. Your Account

To use certain features, you must create an account. You agree to:

• Provide accurate information
• Keep your login credentials secure
• Not share your account with others
• Notify us if you suspect unauthorized access

You are responsible for all activity under your account.

3. Your Content

What You Own

You retain ownership of content you post ("Your Content"), including echoes, comments, messages, photos, and videos.

License You Grant Us

By posting content, you grant MyEchoes a worldwide, non-exclusive, royalty-free, transferable license to use, copy, modify, distribute, and display Your Content in connection with operating and providing the Service.

This license includes the right to:

• Display Your Content to other users based on location and visibility settings
• Create thumbnails and previews
• Store and backup Your Content
• Analyze content for safety and policy enforcement

This license ends when you delete Your Content, except:

• Where others have shared or saved it
• Where we need to retain it for legal or safety reasons
• A reasonable time for backup deletion

Your Responsibilities

You represent that Your Content:

• Is yours or you have the right to post it
• Does not violate any law or these Terms
• Does not infringe anyone's rights

4. Prohibited Conduct

You agree not to:

Post Harmful Content

• Illegal, threatening, harassing, or abusive content
• Content that promotes violence, hatred, or discrimination
• Sexually explicit or pornographic material
• Content that exploits or endangers minors
• Private information of others without consent

Engage in Deceptive Behavior

• Impersonate others or misrepresent your identity
• Create multiple accounts to evade bans
• Spread misinformation
• Manipulate engagement (fake likes, spam)

Abuse the Service

• Access accounts or data without authorization
• Use bots, scrapers, or automated tools
• Reverse engineer or attempt to hack the Service
• Circumvent security features
• Interfere with the Service's operation
• Send spam or unsolicited messages

Violate Location Norms

• Create echoes with false locations
• Use the Service to stalk or track others

We may remove content or suspend accounts that violate these rules.

5. Location Features

MyEchoes is a location-based service. Core features require location access:

• Echoes are tagged to specific locations
• Discovery shows nearby echoes within broadcast radius
• Circles are anchored to locations

By using location features, you understand:

• Your approximate location may be visible to others through your echoes
• You choose your echo's broadcast radius
• You are responsible for content you post at specific locations

Our use of location data is described in our Privacy Policy.

6. Circles

Circle Owners

• Are responsible for content in their circles
• Can set circles as public or private
• Manage membership (approve, reject, remove members)
• May appoint moderators

Circle Members

• Must follow circle rules set by owners
• May be removed by owners or moderators
• Private circle content is visible only to members

Circle owners and moderators act independently. We are not responsible for their moderation decisions.

Platform Trust & Safety Team

To ensure a safe and positive experience across all of MyEchoes, we maintain a small team of trusted platform administrators ("SuperAdmins") who have oversight capabilities throughout the Service. SuperAdmins can:

• Review and moderate content across all circles and public echoes
• Remove content that violates these Terms, regardless of where it was posted
• Assist with membership disputes or moderation issues within circles
• Take action when circle owners or moderators are inactive or not enforcing community guidelines
• Suspend or remove accounts engaged in serious or repeated violations

SuperAdmins act as a safety net to help maintain community standards when local moderation is insufficient. Their role is to support—not replace—circle owners and moderators in keeping MyEchoes welcoming for everyone.

7. Direct Messages

Direct messages are private communications between users. You agree to:

• Not use messages for spam, harassment, or illegal purposes
• Respect others' privacy
• Report abusive messages

We may access message content when investigating reported abuse.

8. Content Moderation

Reporting

You can report content that violates these Terms. We review reports and take appropriate action.

Our Actions

We may, at our discretion:

• Remove content
• Warn users
• Temporarily or permanently suspend accounts
• Restrict features

9. Intellectual Property

Our Property

The Service, including its design, features, code, and "MyEchoes" name and logo, is owned by MyEchoes Software LLC. You may not copy, modify, or distribute our intellectual property without permission.

Copyright Complaints

If you believe content infringes your copyright, contact us at info@myechoes.app with:

• Description of the copyrighted work
• Location of the allegedly infringing content
• Your contact information
• A statement that you believe in good faith the use is not authorized
• A statement under penalty of perjury that your information is accurate
• Your physical or electronic signature

10. Third-Party Services

The Service uses third-party cloud infrastructure services. Your use of the Service is subject to applicable third-party terms.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

WE DO NOT WARRANT THAT:

• The Service will be uninterrupted or error-free
• Content will be accurate or reliable
• Defects will be corrected
• The Service is free of viruses or harmful components

WE ARE NOT RESPONSIBLE FOR USER CONTENT. VIEWS EXPRESSED BY USERS DO NOT REPRESENT OUR VIEWS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

MYECHOES SOFTWARE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

• Loss of profits, data, or goodwill
• Service interruption
• Device damage or system failure

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

• $100 USD, or
• Amounts you paid us in the twelve (12) months before the claim

Some jurisdictions do not allow these limitations, so they may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless MyEchoes Software LLC and its officers, directors, employees, and agents from claims, damages, losses, and expenses (including legal fees) arising from:

• Your use of the Service
• Your Content
• Your violation of these Terms
• Your violation of any third-party rights

14. Dispute Resolution

Informal Resolution

Before filing a legal claim, you agree to contact us at info@myechoes.app and attempt to resolve the dispute informally for at least 30 days.

Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.

Jurisdiction

You agree to submit to the exclusive jurisdiction of the state and federal courts located in Sheridan County, Wyoming for disputes not resolved informally.

15. Termination

By You

You may stop using the Service and delete your account at any time.

By Us

We may suspend or terminate your access:

• For violation of these Terms
• If required by law
• At our discretion

Effect of Termination

Upon termination:

• Your license to use the Service ends
• We may delete your account and content
• Provisions that should survive (including indemnification, limitation of liability, and dispute resolution) remain in effect

16. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms in the app
• Updating the "Effective Date" above

Continued use after changes constitutes acceptance.

17. General

Entire Agreement: These Terms, together with our Privacy Policy, are the entire agreement between you and MyEchoes.

Severability: If any provision is unenforceable, the rest remains in effect.

No Waiver: Our failure to enforce a right does not waive that right.

Assignment: You may not assign these Terms. We may assign our rights to any successor.

No Agency: These Terms do not create any agency, partnership, or employment relationship.
